South Dakota Supreme Court strikes down recreational marijuana amendment

Recreational cannabis use will remain illegal in South Dakota. The state’s high court ruled this morning against a ballot measure, approved by voters last September, to allow recreational use of cannabis.

The court upheld Circuit Court Judge Christine Klinger’s decision from earlier this year. That ruling found that Constitutional Amendment A violated a provision requiring amendments to the Constitution encompass only one subject. The Court agreed with Klinger that Amendment A violated the single-subject rule. However, all three (recreational marijuana, medicinal marijuana, and hemp), all come from the Cannabis sativa-L plant, and the Court could have just as easily found that the bill contained one subject, the regulation of Cannabis sativa-L.
